1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and FluxGood ("Company," "we," "us," or "our") governing your access to and use of the FluxGood platform, including all AI-powered services accessible at fluxgood.com (the "Service").

By creating an account, clicking "I Agree," or otherwise accessing the Service, you represent that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

2. Description of Services

FluxGood provides AI-powered generative media services, including but not limited to:

2.1 Text-to-Image Generation (T2I)

Our text-to-image service converts natural language prompts into visual images using Flux large-scale generative AI models (including Flux.1-schnell and Flux.1-dev by Black Forest Labs). Users submit textual descriptions, and the system produces corresponding images. Key characteristics:

• Powered by Flux.1-schnell (fast, optimized for real-time use) and Flux.1-dev (higher quality, guidance-distilled)
• Output images are generated algorithmically and may vary between requests
• Images are generated at resolutions up to 1024×1024 pixels (higher tiers support additional sizes)
• Processing time typically ranges from 5 to 60 seconds depending on server load and selected model

2.2 Image-to-Image Editing (I2I)

Our image editing service accepts an uploaded reference image together with a text prompt to produce a modified or stylistically transformed output, powered by Flux.1-dev (Black Forest Labs) image editing models. Characteristics:

• Users must hold the rights to upload reference images or ensure images are in the public domain
• The service applies AI-driven transformations; exact results are not guaranteed
• Uploaded images are processed transiently and not stored beyond the generation session
• Output images are distinct derivative works generated by the AI model

2.3 Text-to-Video Generation (T2V)

Our text-to-video service generates short video clips (typically 3–8 seconds) from natural language descriptions, powered by Flux Video (Black Forest Labs) video generation model. Characteristics:

• Videos are rendered at standard resolutions; file sizes and durations may vary
• Processing time is significantly longer than image generation (typically 1–5 minutes)
• Video generation consumes higher computational resources and may have separate usage quotas
• Content restrictions applicable to images also apply to video outputs

2.4 Image-to-Video Generation (I2V)

Our image-to-video service animates a static reference image based on optional text guidance, producing a short video clip, powered by Flux Video (Black Forest Labs). The same content restrictions and user rights obligations applicable to image-to-image editing apply to this service.

3. Eligibility

You must be at least 18 years of age to create an account or use the Service. By using the Service, you represent and warrant that:

• You are at least 18 years old
• You have the legal capacity to enter into a binding contract
• Your use of the Service does not violate any applicable laws or regulations in your jurisdiction
• You are not located in a jurisdiction subject to applicable trade sanctions or embargoes

4. User Accounts

Certain features require registration. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security and confidentiality of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

5. Acceptable Use Policy

You may use the Service only for lawful purposes. The following categories of content are strictly prohibited under any circumstances:

5.1 Prohibited Content Categories

• Sexual / NSFW content: Generating, requesting, or distributing sexually explicit, pornographic, or non-consensual intimate imagery (NCII), including AI-generated deepfakes intended for sexual purposes.
• Violence and gore: Content depicting graphic violence, torture, mutilation, or material that glorifies or incites physical harm to persons or animals.
• Hate speech and discrimination: Content that incites hatred, promotes discrimination, or degrades individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
• Child Sexual Abuse Material (CSAM): Any sexually explicit or exploitative depictions of minors, whether realistic or stylized. Violations will be reported to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement immediately.
• Deepfakes and impersonation: Generating realistic likeness of real, identifiable individuals without their explicit consent for deceptive, defamatory, or harmful purposes; creating fraudulent identity documents or credentials.
• Intellectual property infringement: Reproducing copyrighted characters, brand logos, trademarks, or protected artworks in a manner that infringes third-party intellectual property rights.

5.2 Additional Prohibited Activities

• Using automated scripts, bots, or scrapers to access the Service beyond published API terms
• Attempting to reverse-engineer, circumvent, or disable safety filters or content moderation systems
• Reselling access to the Service or generated outputs in violation of Section 6
• Engaging in any activity that interferes with the integrity or performance of the Service
• Uploading malware, malicious code, or content designed to compromise system security

5.3 Content Moderation

We employ a combination of automated AI safety classifiers and human review to detect policy violations. Detected violations may result in:

• Immediate rejection of the generation request
• Temporary suspension or permanent termination of your account
• Reporting to relevant law enforcement or child protection authorities where legally required

5.4 User Reporting

If you encounter content on our platform that you believe violates this policy, please report it immediately through the following channels:

• Email: abuse@fluxgood.com — for abuse, illegal content, or CSAM reports
• General support: support@fluxgood.com

Reports are reviewed within 24 hours. CSAM reports are escalated immediately to NCMEC and law enforcement with no delay.

6. Content Ownership and Licenses

6.1 Your Input Content

You retain all ownership rights to text prompts and reference images you submit. By submitting content, you grant FluxGood a limited, non-exclusive, worldwide, royalty-free license to process such content solely for the purpose of delivering the requested generation service.

6.2 Generated Output

Subject to your compliance with these Terms and applicable law, we assign to you the generated images and videos produced by your requests. You may use, copy, modify, distribute, and create derivative works from outputs for personal and commercial purposes, except that you may not:

• Claim AI-generated outputs are wholly original human-authored works in contexts where such attribution is misleading or legally prohibited
• Use outputs in a manner that violates applicable laws, third-party rights, or our Acceptable Use Policy

6.3 Feedback and Improvement

We may use anonymized, aggregated data derived from service interactions to improve model quality. We will not use your specific prompts or outputs for training purposes without your explicit opt-in consent.

7. Subscription and Payments

FluxGood offers tiered service plans:

• Free (Guest) — 10 generations per day, no registration required
• Member — 30 generations per day, free with account registration
• VIP — Enhanced daily quota and priority access, paid subscription
• Plus — Maximum daily quota and all premium features, paid subscription

Paid subscriptions are billed through our payment processor. Subscription fees are charged at the beginning of each billing period (monthly or annually, as selected). All prices are displayed in USD unless otherwise indicated.

By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

8. Refund Policy

All subscription fees are non-refundable except where required by applicable law. If you believe you have been charged in error, contact us at support@fluxgood.com within 14 days of the charge. We will review requests on a case-by-case basis.

9. Service Availability and Limitations

We strive to maintain high availability but do not guarantee uninterrupted service. We reserve the right to:

• Modify, suspend, or discontinue any part of the Service with reasonable notice
• Impose usage limits to ensure fair access for all users
• Update AI models, which may affect output style, quality, or capabilities

10. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FluxGood SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) USD $50.

11. Indemnification

You agree to indemnify, defend, and hold harmless FluxGood and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) content you submit to the Service.

12. Termination

Either party may terminate the agreement at any time. You may close your account by contacting us. We may suspend or terminate your access immediately if we determine, in our sole discretion, that you have violated these Terms. Upon termination, your right to use the Service ceases immediately. Sections 6, 10, 11, and 13 survive termination.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which FluxGood operates, without regard to conflict of law principles. Any dispute arising from these Terms that cannot be resolved informally shall be submitted to binding arbitration in accordance with applicable arbitration rules. You waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Changes to Terms

We may update these Terms from time to time. We will provide notice of material changes by posting the updated Terms with a revised "Last updated" date and, for registered users, by email notification. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
